1. SCOPE
1.1. This Privacy Policy explains how NG Metalúrgica deals with personal information received by the User when using the NG Metalúrgica Site (“Site”). As the User accesses and performs any operation in the Site, the User declares that he/she is aware of the content of this Policy and gives his/her consent to the Data Processing performed in the terms and conditions set forth herein.
1.2. This Policy is not intended to replace other notices or communications provided as required by applicable Laws.
1.3. To the extent that NG Metalúrgica provides a separate or supplemental notice or authorization relating to the Processing of Personal Data, this notice or authorization will prevail, to the extent applicable and within its limits, in case of any conflicts.

2.1. NG Metalúrgica is concerned with privacy in the technological environment and understands as equally relevant the address of the Personal Data handled from its Sites. For this reason, NG Metalúrgica uses this Privacy Policy to describe, explain and indicate rights and obligations in the Treatment of Personal Data, which facilitates the practices of use and the choices that the User can make about the way their information is used.

3.1. The definitions below serve as reference for the User to have a proper understanding of this Privacy Policy.
3.1.1. User: is the natural person to whom the personal data subject to Treatment refer to.
3.1.2. User: is the natural person to whom the personal data subject to Treatment refer to.

Law: means all applicable constitutional and infra-constitutional Law, which includes, but is not limited to, the laws, decrees, ordinances, resolutions, normative instructions and other regulations issued by the competent power. In particular, Law n. 13,709 of August 14, 2018 – General Law of Protection of Personal Data (“LGPD”).
3.1.4. Law: means all applicable constitutional and infra-constitutional Law, which includes, but is not limited to, the laws, decrees, ordinances, resolutions, normative instructions and other regulations issued by the competent power. In particular, Law n. 13,709 of August 14, 2018 – General Law of Protection of Personal Data (“LGPD”).
3.1.5. NG Metalúrgica: means NG Metalúrgica S.A., a private limited liability company headquartered at Avenida Dr. Morato, 190 – Vila Rezende, Piracicaba/SP CEP 13405-260.
3.1.6. Operator: is the natural or legal person, of public or private law, who performs the processing of personal data on behalf of the Controller.
3.1.7. Processing: is any operation carried out with Personal Data, such as those related to collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination or extraction from Personal Data.
3.1.8. Controller: is the natural or legal person, governed by public or private law, who is responsible for decisions regarding the Processing of Personal Data.
4. WHICH PERSONAL DATA DOES NG METALÚRGICA PROCESS AND WHAT ARE THEIR PURPOSES?
4.1. When the User accesses the Sites and performs any operation, we collect some personal information that the User provides us, such as name, email address, phone number and IP address.
4.1.1. In more details, NG Metalúrgica´s Site has a system of forms to be filled according to the type of communication intended by the User, who may choose between applying for job openings at NG Metalúrgica or choosing one of NG Metalúrgica`s areas to contact.
4.1.2. Besides these Personal Data, NG Metalúrgica may collect any other Personal Data that the User may send/give to NG Metalúrgica as a result of the upload of files in the application forms of the Site.
4.2. NG Metalúrgica also has a customer service channel by telephone, whose contact number is in NG Metalúrgica’s Site. For this reason, once the User provides his Personal Data through a contact by telephone, NG Metalúrgica may treat such Personal Data to satisfy the demand presented by the User through that channel.
4.3. Similarly to the previous item, NG Metalúrgica also has a platform that allows the User, who is also a supplier, to manage his negotiations with NG Metalúrgica. The Personal Data provided by the User with the purpose of supplying products and services to NG Metalúrgica, in any of its Sites, will also be treated for such purpose.
4.4. We may also ask the User authorization to collect information not described in this Privacy Policy. When this happens, NG Metalúrgica will make explicit to the User the use we will make of the collected information.
4.5. The collection of Data may be used to provide the services and support and/or perform the transactions the User has requested; send security and transaction status communications, prevent fraud and other illegal and prohibited activities, and ensure the integrity of our Sites, products and services.
5. HOW DOES NG METALÚRGICA COLLECT/RECEIVE PERSONAL DATA FROM THE USER?
5.1. NG Metalúrgica collects and/or receives Personal Data through the completion of some fields and forms in its Sites. In particular, NG Metalúrgica collects Personal Data when the User fills the form in the Sites to establish any contact or when the User opts to receive NG Metalúrgica’s newsletter.
5.1.1. Additionally, the Sites may provide a specific field for the receipt of curricula and other data of potential candidates to the positions offered by NG Metalúrgica.
5.2. Besides, NG Metalúrgica also stores and uses information and access credentials (cache) in its Sites in order to improve the User’s experience, as well as for statistical access control.
5.3. Moreover, NG Metalúrgica uses cookies, which are information sent to and stored in the User’s browser. This information allows NG Metalúrgica to recognize, store and follow the User’s navigation by NG Metalúrgica. The User must accept the cookies policy of NG Metalúrgica, which is available in the Sites.
5.3.1. The purpose of the cookies is related to the personalized offer of advertising content and the facilitation of the future filling of forms in the NG Metalúrgica Sites.

6. HOW DOES NG METALÚRGICA TREAT THE USER’S PERSONAL DATA?
6.1. All Personal Data that the User provides us through the use of the Sites are confidential and will not be shared with third parties, except as provided in this Policy. By accepting this Policy, the User expressly and unequivocally declares that he/she authorizes the sharing of Personal Data herein informed.
6.1.1. Anyway, either by NG Metalúrgica or by any other partner or informed customer, the User will always have the option to unsubscribe in eventual mailings or any other form of communication.
6.2. We may be obliged to share User’s information by force of applicable Law, to assure the execution of public policies provided by Law, as well as national security and international legal cooperation, according to applicable rules.
6.3. The NG Metalúrgica Sites contain hyperlinks to other sites on the Internet, in particular to make available job vacancies. This Policy applies only to these Sites and does not bind any other, including those reached by the hyperlink of these Sites. NG Metalúrgica has no responsibility or control over those other Internet sites, use and disclosure of User’s personal information, and has no control over the privacy policies of other sites. When you leave our Sites, please consult the privacy policy of the sites you access.
7. FOR HOW LONG WILL MY PERSONAL DATA BE PROCESSED?
7.1. According to NG Metalúrgica’ Personal Data retention policy, we will keep Personal Data for as long as necessary to achieve the purposes for which they were collected and/or received.
7.2. After this period, such information will be stored in the mandatory form required or allowed by applicable Law, for the main purpose of providing confirmation of your details with authorities, if requested by the User, in case of portability or otherwise regulated by applicable Laws, and for the internal NG Metalúrgica business purposes.

8.2. Seeking to ensure transparency, this Policy states that the User has rights to control the Treatment of his Personal Data. These rights, when applicable, include:
a) the right to request access to your Personal Data at any time, which shall be free of charge. The User may do so through a request to NG Metalúrgica through one of the contacts provided in this Policy;
b) The right to request correction of their Personal Data;
c) The right to contest the treatment of his/her Personal Data;
d) The right to restrict the processing of your Personal Data;
e) The right to demand erasure of your Personal Data;
f) The right to request that your Personal Data be anonymized, provided that such anonymization does not affect the lawfulness of the processing previously carried out and provided that such measure is technically and financially feasible;

9. CAN THE RIGHTS BE RESTRICTED?
9.1. As determined by Law, some Personal Data are essential for the fulfillment of immediate and future legal obligations by NG Metalúrgica. In this sense, in cases where the exercise of the right of the owner of the Personal Data conflicts with any of these legal obligations, NG Metalúrgica has the obligation and the right to limit the exercise of the User’s rights, as provided in the LGPD.
9.2. Moreover, in cases of excessive demands for the exercise of rights of the holders of Personal Data, delays may occur in the fulfillment of requests from the holders, which in no way implies breach of the legal obligations of NG Metalúrgica.
9.3. Furthermore, NG Metalúrgica will always inform the applicant holder of Personal Data the deadlines for fulfillment of the requests, as well as the deadlines in the events of delay due to excess demand or any other event that justifies it.

Applicable Legislation and Competent Court: This Policy is governed, interpreted and regulated by the Brazilian legislation, being competent to solve any doubts, questions and/or disputes arising from this Policy the court of NG Metalúrgica headquarters, renouncing the User to any other, however privileged it may be.
